Welcome to Festy – Celebrate the Moments that Matter 
These Terms of Service ("Terms") govern your access to and use of the Festy mobile application and related services ("Services") provided by Festy LTD ("Festy", "we", "our", or "us").

By using Festy, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the app.
 

1. Acceptance of Terms

By creating an account or using Festy, you confirm that you:

• Are at least 13 years old (16 in the EU), and

• Have the legal capacity to enter into these Terms
   

2. Changes to Terms

We may update these Terms from time to time. Continued use of the app after updates means you accept the revised Terms.
 

3. Account Registration

To use Festy, you must create an account.

You may sign up using:

• Your phone number, or

• Third-party sign-in providers (e.g., Apple or Google)

You are responsible for:

• Maintaining the security of your account

• All activity under your account
   

4. Use of the App

Festy is designed to help users remember and celebrate important moments.

You agree to:

• Use the app only for lawful purposes

• Not misuse, disrupt, or interfere with the app or its systems
   

5. User Content

You may upload or input content such as names, birthdays, reminders, and notes.

You retain ownership of your content. However, you grant Festy a non-exclusive, royalty-free license to use, store, and process your content solely to operate, improve, and personalise the Services.
 

6. Social and Sync Features (FestySync)

Festy may provide features that allow you to:

• Sync contacts

• Connect social accounts (e.g., Facebook, Snapchat)

• Receive suggestions for connections and birthdays

By using these features:

• You confirm you have permission to share any data you upload

• You understand that suggestions may be generated based on your data and your network

These features are optional and can be managed in your settings.

7. Gifting Services

Festy enables users to send digital gifts and gift cards through third-party providers, including Tillo.

By using gifting features:

• You agree that gift fulfilment is handled by third-party providers

• Festy is not the issuer of gift cards and does not control third-party products or services

• All purchases are final unless otherwise stated by the provider

• You are responsible for ensuring recipient details are correct

Festy may store and use transaction data to:

• Facilitate gift delivery

• Improve the user experience

• Provide personalised gift recommendations

Festy is not liable for:

• Issues with third-party gift providers

• Delays, errors, or failures in gift fulfilment

• Losses arising from incorrect recipient information

8. Payments

All payments made through Festy are processed by third-party payment providers.

• Festy does not store or process your payment card details directly

• Payment processing is subject to the terms and policies of the relevant third-party provider

• By making a purchase, you agree to those third-party terms

Festy is not responsible for payment processing errors, failures, or security breaches arising from third-party providers.

9. Third-Party Services

Festy integrates with third-party services (e.g., Apple, Google, Facebook, Snapchat, and gifting providers).

By using these integrations:

• You agree to the relevant third-party terms and policies

• Festy is not responsible for the actions, content, or services of these third parties

10. Intellectual Property

All content and software within Festy (excluding user content) is owned by Festy LTD or its licensors and is protected by intellectual property laws.

You may not copy, modify, distribute, or exploit any part of the app without permission.

11. Prohibited Conduct

You agree not to:

• Use the app for illegal or harmful purposes

• Upload content that infringes on others’ rights

• Attempt to access systems without authorisation

• Interfere with the operation or security of the app

12. Child Safety

Festy is committed to user safety and preventing abuse, including child sexual exploitation. We may take action, including account suspension, where necessary to protect users.

13. Termination

We may suspend or terminate your account at any time if:

• You breach these Terms

• It is necessary to protect users or comply with legal obligations

14. Disclaimers

Festy is provided “as is” and “as available.”

We do not guarantee:

• The app will be uninterrupted or error-free

• That reminders, notifications, or gifting services will always function correctly

15. Limitation of Liability

To the fullest extent permitted by law, Festy LTD shall not be liable for:

• Indirect or consequential damages

• Loss of data, profits, or opportunities

• Issues arising from third-party services or integrations

• Errors, delays, or failures in reminders or gift delivery

16. Indemnification

You agree to indemnify and hold harmless Festy LTD and its team from any claims arising from:

• Your use of the app

• Your content

• Your breach of these Terms

17. Governing Law

These Terms are governed by the laws of England and Wales.

Disputes will be subject to the exclusive jurisdiction of the courts of London, United Kingdom.

20. Entire Agreement
